This is the last Will and Testament of me William Terrey of Horne in the County of Surrey Farmer First I order and direct the payment of all my just debts, funeral and testamentary expenses by my executors thereinafter named I give and bequeath unto my executors thereinafter named all and singular my property whatsoever whosoever and of what nature kind and quality soever the same may consist In Trust and I direct my executors to allow and suffer my wife Deborah Terry to use and occupy all and singular my said property for her own use and benefit during the term of her natural life and immediately after her decease I direct my said executors to make sale and dispose of so much of my said property as they shall find necessary for the payments thereinafter expressed that is to say to pay and apply to my daughter Sarah the sum of ten pounds To my Son William Terry one shilling To my daughter Phillis the sum of ten pounds To my daughter Ann the sum of ten pounds To my daughter Elizabeth the sun of five pounds But and in case that either of my said children should depart this life before such expensive legacy or aforesaid shall become payable leaving issue such issue to receive their parents intended share or part equally as they shall severally attain the age of twenty one years my executors in the meantime to have the privilege of holding in their hands such childs or childrens share or shares untill the same shall become such and payable all the rest residue and remainder of all my said property I give and bequeath unto my son Thomas Terry for his own use and benefit And I thereby nominate constitute and appoint my Brother John Terry and George Jupp both of Horne aforesaid Farmers Executors of this my will thereby revoking and making void all former wills and testamentary dispositions by me at any time made And I direct my said executors to reimburse themselves respectively all costs for loss of time and expenses issued by them in the execution of the trusts of this my will And I hereby declare this to be my last will and Testament In Witness whereof I have to this my will contained in one sheet of paper set my hand at the bottom thereof this fifteenth day of February One thousand eight hundred and forty one William Terrey (his mark) Signed and declared by the said William Terry the Testator as and for this last will and Testament in the presence of us confirm this presence at the request in the presence of each other and at the same time have subscribed our names as witnesses Edward Turner Haybinder James Jenner Miller
Proved at London 10th August 1842 before the Worshipful Robert Joseph Phillimore Doctor of Laws and Surrogate by the Oath of John Terrey the Brother one of the Executors to whom Administration was granted having been first sworn duly to Administer Power reserved of making the like Grant to George Jupp the other Executor when he shall apply for the same.
